These Terms of Use are effective on August 6, 2014

Welcome, and thank you for visiting templesociety.org.au and/or its affiliated sites including Temple Society-managed sites on third-party platforms (collectively “Sites”) which are owned and operated by the Temple Society Australia (“us”, “we”, or “our”).

Your access to and use of these Sites is based on your acceptance of and compliance with the Terms outlined below as well as any additional terms outlined within the specific service you access. These Terms apply to all visitors, users and others who access or use these Sites.

We welcome your comments, images, photos and other material, including data, text, files, information, graphics, audio and video clips, applications, and links (collectively “Content”) on our Sites. At the same time, users should show courtesy and respect to others and must not abuse this autonomy.

If you do not agree to be bound by all of the Terms, do not access or use these Sites.

1. Copyright

Unless otherwise stated, all material, including logos, images, names, designs, trademarks and Content, contained on our Sites is the property of the Temple Society Australia and is protected under Australian copyright law. Such material is provided for your personal, non-commercial use only and may not be reproduced, republished, modified, adapted or translated without our prior written permission. Our Sites may also include material whose copyright belongs to third-parties and which has been lawfully included in this site by agreement or specific licence.

2. Privacy

Your privacy is very important to us. We have developed our Privacy Policy in order for you to understand how we collect, communicate, disclose and make use of personal information. Any personal details and data acquired by the Temple Society Australia from your participation in any of our Sites will be used in accordance with this policy.

3. Disclaimer

Temple Society Australia reserves the right to enforce these Terms at its discretion, by deleting, editing or modifying any Content and/or closing any Site at anytime with or without notice or cause.

3.1 Limitation of Liability

In no event shall Temple Society Australia or its providers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on our Sites, even if Temple Society Australia or a Temple Society Australia authorised representative has been notified of the possibility of such damage.

By participating in a Site, you undertake to indemnify the Temple Society Australia and its employees and sub-contractors against any liability arising from any illegal and unlawful Content published on a Site and against all damages, losses, claims and costs (including without limitation all expenses incurred in conducting or defending any proceedings) arising from any such publication.

3.2 No Warranties

We provide the material on our Sites on an “as is” and “as is available” basis. The Temple Society Australia makes no warranties of any kind either expressed or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement of intellectual property or other violation of rights. Further, Temple Society Australia does not warrant or make any representations concerning the security, reliability, timeliness accuracy, likely results, or performance of its Sites, any Content contained therein, or on any sites linked to this site.

3.3 Links to Other Web Sites

Our Sites may contain links to third-party websites or services that are not owned or controlled by Temple Society Australia. The Temple Society Australia has no control over the availability or accuracy of such websites, nor does it have any responsibility for the Content, products, policies or practices on or available from such websites or services. The inclusion of any link does not imply endorsement by Temple Society Australia of the site. Use of any such linked website is at the user's own risk.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

4. Google Analytics

The Temple Society Australia uses Google Analytics to gather statistics about how our Content is used and statistics about our visitors, such as their browsers and geographic location. No personally identifying information is collected.

To opt-out of Google Analytics, you can download a browser add-on from Google. Alternatively, you can set your browser to refuse or delete cookies from Google Analytics. Check your browser's help information to find out how.

5. Online Communities

5.1 Registration

You may be required to register an account in order to access and/or contribute to certain Temple Society Australia Sites.

5.1.1 Sites Administered by the Temple Society Australia

The Temple Society Australia may refuse registration of users whose suggested login names are considered inappropriate, impersonating another person or attempting to create multiple accounts for or on behalf of a suspended member.

You may terminate your account at any time by unsubscribing (where that option is available) or by contacting the Temple Society Australia at tsa@templesociety.org.au. However, your Content may continue to be available online after termination.

When you create an account with us, you must provide information that is accurate, complete and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

5.1.2 Third-party Registration

You may be required to register an account with a third-party site in order to access and/or contribute to certain Temple Society Australia Sites. In these instances, your account registration is subject to the terms of that site.

5.2 Account Name and Password

You are responsible for keeping your account name and password confidential and for any actions under your password, whether your password is with our Sites or a third-party site.

You agree not to disclose your password to any third-party. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.

5.3 Contributing Content

You are solely responsible for your conduct and any Content that you upload or otherwise submit, and for any consequences.

You retain ownership of the Content you upload or submit.

All Content will be considered submitted on a non-confidential basis.

The Content you submit, post or display may be able to be viewed by other users of the Sites and through third-party services and websites. You should only provide Content that you are comfortable sharing with others under these Terms.

5.4 Acceptable Use

By participating in our Sites, you agree that you will not submit any unacceptable Content or engage in any unacceptable activities, which includes the following:

Uploading, transmitting, posting or making available any Content that is threatening, abusive, hateful or inflammatory, invasive of another’s privacy, sexually explicit, vulgar or obscene, harassing, hurtful or harmful to any other person and which constitutes bullying or intimidation.

Participating in any activity that could constitute grooming children, or other crimes against minors.

Uploading, transmitting, posting or making available any illegal or unlawful Content including, but not limited to, certain types of pornography, defamatory and discriminatory Content of any kind, Content that could constitute racial or religious vilification, stalking, fraudulent activity, computer crimes or any activity that constitutes a criminal offence or otherwise breaks the laws of the Commonwealth of Australia or Victorian State Legislation.

Impersonating any person or entity while online, or registering with a false identity.

Transmitting any Content, or participation in any activity, that is prohibited by law, including laws governing data privacy or protection, copyright law or the permissible uses of intellectual property, and which infringes copyright, trademark or other proprietary right of any party, or which is in breach of any legal duty to a third-party, such as a confidentiality agreement.

Uploading, transmitting, posting or making available, any form of unsolicited or unauthorised advertising, promotional materials, junk mail or spam, including promoting your own business or any type of commercial solicitation.

Collecting information about others, including email addresses and personal information.

Content must be relevant, accurate and contain opinions that are genuinely held by the user. It is understood that all Content expresses the views of the respective author, and not the views of the Temple Society Australia.

5.5 Moderation

Content will be reviewed by us and is subject to our Terms of Use.

We reserve the right to moderate all Content, including the right to delete unacceptable Content or any other Content that is deemed objectionable at our discretion. However, we are under no obligation to oversee, monitor or moderate any Content and do not control the material submitted by users. We will attempt to remove or edit any objectionable material, however, there is always a possibility that, by using these Services, you may be exposed to Content that you find objectionable.

5.6 Termination of Access or Use

Temple Society Australia reserves the right to block, suspend or terminate the user rights of any Site participant at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

If you wish to terminate your account, you may simply discontinue using the Site.

6. Complaints and Reporting Abuse

If you have any concerns about Content accessed through any of our Sites, or think that anyone is violating these Terms, please alert the moderator of that Site (where applicable) or contact the Temple Society Australia by email at tsa@templesociety.org.au or by writing to 152 Tucker Road, Bentleigh, VIC, 3204.

7. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new Terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Sites after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, please stop using any of our Sites.
